1. General

1.1 Apes Booking Vacations Limited, operating as Apes Booking, specializes in organizing tours and travels in Uganda and the East African Region. In these terms and conditions, “you” and “your(s)” refer to all persons named on the booking form/contract, while “company,” “we,” and “us” denote Apes Booking Vacations Limited.

1.2 Your confirmation of conducting your tour expedition/safari with us implies that you have fully read and understood these terms and conditions.

2. Application of these terms and conditions

2.1 Your travel with us or your contract with us regarding your expedition/safari and all bookings are subject to these terms and conditions. For clarity, these terms and conditions form part of your contract with us and all transactions.

3. Communications and Documents

a) All communications from Apes Booking Vacations related to your safari will be sent to you from our official email addresses: info@apesbookingvacations.com

b) All documents, including invoices, confirmation vouchers, and receipts, will be on the company’s document papers and may bear the company seal.

c) The company is not liable for any losses due to failure to transact with us in compliance with the above communication procedure.

4. Payments to Us

a) All payments must be made directly to the company, either to the company’s account through Bank Transfer, online payment, or by cash.

b) Consideration of booking for the safari is upon payment of a deposit of 40% of the total trip cost. The balance of 60% should be paid within 60 days from the safari’s start date.

c) Any safari involving Gorilla and Chimps tracking requires payment of the necessary permit fees at the time of booking, increasing the initial deposit.

d) If you book a Safari less than 60 days in advance, you must pay the entire tour price to confirm your reservation.

e) Our safari prices are quoted in US dollars, and payments are desirable in US dollars.

f) The person signing the booking form and the contract guarantees payment. It is your responsibility to ensure the Company receives payment in full by the due date.

g) The Company reserves the right to refuse a booking or cancel the Safari, returning any money received.

h) The company may increase prices quoted if circumstances warrant an increment for successful safari execution.

5. Cancellations, Changes, and Incidental Refunds

5.1 Cancellations by You

Should any member of the Safari team cancel:

a) 60 days prior to the date of arrival: 25% Charge b) 45-59 days prior to the date of arrival: 50% charge c) 30-44 days prior to the date of arrival: 75% charge d) 0-29 days prior to the date of arrival: 100% charge

Please note that these charges also apply if you shorten your stay or reduce the number of people in your travel party. We recommend purchasing travel insurance to protect against unexpected events leading to trip cancellation.

5.2 Changes by You

If you need to make changes to your itinerary, inform us as soon as possible. Some changes may not be possible due to factors like accommodation and transportation availability.

If changes are possible, additional charges or fees may apply, communicated to you beforehand.

5.3 Changes or Cancellations by Us

While we strive for your safari’s success, unforeseen circumstances may necessitate changes or cancellations. We will inform you as soon as possible, providing alternative options.

If we cancel, we refund all payments made, not liable for other expenses. For significant itinerary changes, you may choose to accept the changes or cancel and receive a full refund.

5.4 Travel Documents and Vaccinations

Ensure you have necessary travel documents, vaccinations, and medical certificates. Check local embassy requirements. Lack of required documents or vaccinations absolves us of liability for cancellation charges.

5.5 Insurance

Purchase comprehensive travel insurance covering medical expenses, personal accidents, loss of baggage, and trip cancellation. Failure to purchase insurance makes us not responsible for costs or losses due to unforeseen circumstances.

5.6 Liability

While ensuring safety, we are not responsible for injury, illness, death, loss or damage to property, unless directly caused by our negligence. Our liability does not exceed the total amount paid for the safari.

5.7 Force Majeure

We are not responsible for delays or failures due to events beyond our control, such as acts of God, natural disasters, war, or terrorism.

5.8 Governing Law and Jurisdiction

This agreement is governed by the laws of the Republic of Uganda. Disputes are subject to the exclusive jurisdiction of Ugandan courts.

5.9 Entire Agreement

This agreement constitutes the entire agreement between you and us, superseding all prior agreements.

6. Consent

By consenting to this agreement, you acknowledge reading, understanding, and agreeing to all terms and conditions herein.
